In using this website and its Mobile Application (Foodoo) you are deemed to have read, understood and agreed to the following Terms and Conditions set forth by Foodoo (MSquare Enterprises):
In this relationship we define ourselves as the facilitator for great deals between Users (our members) and Partners (Restaurants, Hotels, Travel and custom Service Providers, Experience Specialists, Entertainment Oriented Businesses etc.) which have been listed and shall be listed in future on our Website and Web Application Interfaces based on business expansion protocols.

User Agreement

This website and the Foodoo App are published and maintained by MSquare Enterprises
When you access, browse or use any services provided by Foodoo, you accept the terms and conditions set forth below, without limitation.
These Terms and Conditions constitute the entire agreement between Foodoo (MSquare Enterprises) and the user with respect to the use of the website, mobile application or any other services offered solely by Foodoo.

Terms of Use

By utilizing the services and Benefits of Foodoo, be it the website, mobile application or entertainment and cab service, you acknowledge that you have read and understood the terms of use and agree to be bound by them.
While people under the age of 18 can use the services of Foodoo, they must do so under the guidance of their parents and/ or legal guardians.
With regards to any services provided by Foodoo involving the consumption of alcohol, the user must warrant that they are of legal drinking age in strict adherence to specific state laws and the laws laid down by Government of India.

Is your personal information safe ?

We at Foodoo are committed to protecting and ensuring your privacy. Only authorised employees within the company have access to user details and information & are prohibited from using this information for any personal or commercial use.
Client records are regarded as confidential and will not be divulged to any third party, other than to appropriate authorities, only if legally required. We will not sell, share, or rent your personal information to any third party.
Any emails sent by this Company will only be in connection with the provision of agreed services and products.
We also need to share customer's details with specific restaurant, where reservation has been made, for better customer experience. Restaurant may also contact customers for the given reservation or for any promotions afterwards.

What is Foodoo accountable for?

1. Foodoo offers a reservationbook a tableservice between the users and the restaurant partners howsoever it does not accept any liability arising out of the users dining experience regarding quality of service or food, as it is being delivered by the restaurant partner chosen 1. The monetary transaction is between the restaurant partner and the member, Foodoo plays as a facilitator in this relationship for best experience and delivery.
2. Foodoo Club Benefits can be used only once at each partner Destination in a day (Food or Beverages or Both as per the Partner Member association parameter, to be served under one billing norm). In case of Travel and Entertainment, separate Rules of Engagement shall be set forth based on business parameters of association.
3. Foodoo Club offer should be presented to the Partner Restaurant before the start of service. Customers to notify partner restaurants about their Foodoo membership at the time of giving an order, otherwise, membership benefits shall not be honoured, and unlocked order shall be deemed as used (invalid).
4. Use of Foodoo Club membership requires a minimum of 2 people on restaurant / food partner table. For other services it can be used as an individual.
5. Member must be physically present at the time of redeeming Foodoo benefits. Member must carry a valid central government ID as proof of identity if asked to identify his/her identity. Non-identification may lead to disqualification of the offer and unlocked offer shall be treated as used (Invalid)
6. Foodoo Club Offers cannot be combined with other offers.
7. Partner Destinations may charge additional charges, including but not limited to service charge, GST etc. as per the government policies, Foodoo club benefits don't include these charges as they are fixed government taxes and charges, which are to be borne as extra by the member. Example: if a Foodoo member gets a food/drink voucher unlocked which gives him access to offers of (1+1 Food) or (2+2 Drinks) then in that case. Service charge / GST / any other state or central government tax on the free item if applicable as per government mandate needs to be paid by the Foodoo member as extra.
8. (a) Non-Alcoholic Restaurants/Institutions shall not qualify to be Beverage(s), Partner. And as per Government mandate, Foodoo members who are less than government authorised drinking age will not be served Alcoholic beverages. Restaurants may ask for age proof if they are not satisfied with the age of the member. (b) Non-Alcoholic Restaurants which are only in the business of Serving Beverages, Ice-creams, Smoothies etc. of similar nature, will not be exempted from Foodoo Partnership Nomenclature and would be eligible to partner Foodoo as a Beverage Partner. This exception is being allowed keeping in mind the Member and Business interests on both sides.
9. Complimentary drinks deal as applicable like (1+1), (2+2) or any other being promoted by a Food and Beverage Partner, shall be applicable for the same brand of liquor or alcohol ordered, so, if a member orders for a Brand like ‘Signature' then the complementary order would be for a ‘Signature' Brand only; similarly, drink for a Drink as per type, mocktail for a mocktail, and cocktail for a cocktail etc. The mandate is what you order first as paid you shall be offered the same drink free (Unless the partner restaurant is willing to serve something else of the same or lower value as per the member's request, which will purely lie at the discretion of the partner restaurant and his relationship with the member). Again, Deals are dependent on what is being flashed at the time of Ordering by the Partner Destination, if it’s a discount applicable then it will be honoured as per the mandate of what is being ordered.
10. Foodoo Club is not valid on deliveries and takeaways. The takeaway of leftovers is at the discretion of the restaurant partner.
11. Foodoo Membership plan will have a minimum lock-in period of 90 Days from the date it is availed, after the completion of the lock-in period the membership can be cancelled if the member so wants to do, in this case, refund shall be initiated post deduction of the usage period charges as per the membership tariff applicable at the time of initiation or renewal of membership norm.
Example: If Varun has taken an Annual Foodoo membership in Jamshedpur city, and after 100 Days he gets transferred to a different city where Foodoo membership is not valid, then, in that case, he can ask for cancellation of his membership from the app. In that case, he will still need to validate the cancellation on mail from his registered email id (so that the request validity is confirmed). Now within a period of 10 Days to a maximum of 15 Working days or Earlier, his refund shall be processed on his Bank account / Wallet as per the registration details. The process of refund to be followed in that case would be equal to “Annual Charges minus charges for 90 days as per tariff card, and pro rata calculation for 10 Days on charges to be applicable for the period 91 to 180 Days.” Similar refund process shall be initiated as per refund days applicable. Foodoo Member would get a notification on Mail or SMS about the refund amount and details at the time of cancellation. If in case, a member is not satisfied with the refund amount or process, they may mail for details of the refund on cs@foodoo.in (within 72 Hours your issue would be resolved from the time a ticket is raised, Sunday's will be treated as non-working days, in that case, the resolution time shall increase). 12. Foodoo membership plan shall be automatically renewed after the expiry of the membership plan, post fulfilment of the payment clause (Online or through Wallet purchase). Once renewed membership cannot be cancelled in the first 90 days which shall be treated as lock-in period (If cancelled then refund shall be initiated post deduction of the applicable lock-in period charges). Renewal notification message shall be sent to members on registered email id and mobile number (Through SMS), 3 (Three) days prior to the renewal date, members may cancel the order(s) at that time if they don’t wish to continue with the membership. Post the stated time as defined here 3(Three) days, membership will be auto renewed and then the lock – in nomenclature defined above in clause 11 shall be applicable.
13. It would be the endeavour of Foodoo team to add more partner destinations, service providers and cities with time, and members can avail more deals in the additional partner destinations or cities, at no incremental cost. There may be a reshuffling of deals across partner destinations with time, to accommodate consumer interest and requests, which will be updated real-time on the app and website(s). This will help members explore more across the city outlets and enjoy better deals.
14. Foodoo team will have the rights to alter, change and update the terms of association with time, and once such a change is done it will be notified to the members through different channels of communication(s) including messages on E-Mail and SMS on registered numbers.
15. It will be an endeavour to protect member data in terms of purchases, offer utilization, and critical registration information by the Foodoo team. And it will be done through the various layers of security that will be inbuilt in the software coding through SSL's
16. Member Comments outside the Foodoo Platforms shall not be the responsibility of Foodoo team to manage, this applies to negative comments, Spreading Fake News, Spreading/messaging derogatory comments, commenting against State/Government policies etc. which hurt Institution(s) Image, City/State/Nations Image or a person’s image in the society. Appropriate penal action may be institutionalized against the commenting member as per the rule of the land/law. Foodoo team/Organization shall not be liable for any member actions of this nature.
17. Members through this subscription and memberships, allows Foodoo team to send information to them about various offers, newsletters, coupons etc. which can enhance their Foodoo experience. At any time, members can opt out of the service by disengaging on the app notifications and by pressing the unsubscribe button/link on the emailers or newsletters.
18. Foodoo Club provides a service between users and partners and has no control or right over specific partner policies in terms of how to avail a service or age for availing a service. This control will always lie with the Partner property / service our endeavour shall be to provide best deals within these applicable constraints if any.
19. All users will have to agree and adhere to the policies set by the partners from where or whom they take the service and deal.
20. These policies include but are not limited to; child policy, legal age of entry and legal drinking age.
21. We will investigate any written complaints against a restaurant on receipt of complete details on mail through our legal team as per the applicable nomenclature defined under the Indian Laws.
22. Any acts of vandalism, Narcotism, mischief, loss to property, reputation or any other loss to a partner’s operational comfort shall be considered as legal offence and shall be punishable with the loss to be borne by the user (Foodoo Member). Foodoo shall not be liable to any financial or legal mandates due to these conditions.
23. Foodoo is a Business Service provider, mandated to display and provide the best deals in business operational towns, without any legal or proprietary rights for operations of Partner restaurants, Hotels, Travel Partner and Professional Services, Entertainment centres who are associated on Foodoo Platform(s). So service is purely at the discretion of the partner(s) and users shall have the duty to bind themselves in getting the best service to be delivered for them. Foodoo shall not be liable for service-related glitches at partner destinations or locations.
24. If in case a member is not able to get the deal as proposed on the Foodoo Website or web application platforms at the time of ordering the service, then in that case he can call Foodoo customer service directly for best resolution of the

As a trustworthy Organization, we feel we must be clear in our transactions even before an action happens or takes place, that’s why what we are appending below is to build the trust in case of breach of any nature. Let’s think some negatives, because positives are things that we shall deliver for sure as a part of the relationship.

What happens In Case of Closure of Foodoo, how will the members be treated and taken care at that time?

1. Foodoo if at all turns negative and needs to close, at any point in time, in that case, it shall not accept any new membership or shall charge any convenience fee from new members for new services being taken at that time or post that time.
2. For old members, as a mandate it will continue to operate its business in the applicable markets till the time the last member who has taken its Monetary service completes its term post which renewal shall not be applicable (with a prior communication to the member about the closure in operations)
3. In such a scenario where Foodoo may not be able to run its business operations on an operational level as defined in clause 2 above, then Foodoo will return pending amount to customers as per the membership return policy laid down in the terms of association for membership defined in the member association charter under membership plans defined for renewal and new membership terms.
4. Foodoo is a tech based product without any physical presence in terms of paper / plastic interface, therefore our partners would not need to entertain any customer requests of any kind in terms of membership benefits if the application closes down, since codes shall not open for customers to avail services of any new kind. This clause shall be applicable post the points 1, 2 and 3 as per applicability has been met to its conclusion. So technically, Foodoo application shall not open codes as mandated to generate deals for customers, thereby keeping partners away from any obligations of any kind. Similarly, for users the terms defined in points 1, 2 and 3 defined above should be the Guiding rules for engagement as per the clause defined above.

User Communication Guidelines

We send our Foodoo Members regular communications about our products and offers.
Any activity related to user wallet transaction will also be communicated to customers via SMS and Push.
Users can send us email to remove them from marketing communications, however, they will always get messages related to bookings, wallet transactions.

User Feedback &Review Guidelines

Here are a couple of things to keep in mind while writing your reviews and Feedback:

You can leave a review about your experience by visiting the restaurant page & clicking on “Write your own review” on the User Review section OR by clicking on “Write A Review” tab on the notification you receive from our side after you have dined at the restaurant.
All reviews need to be a minimum of 140 characters long.
Simply tap on the circles to give a rating out of 5. From 1 being “Terrible” to 5 being “Excellent”.
You will be asked to enter your month of visit, type of visit & a suitable title for your review.
Then you can start to write the review about your experience. You can also add pictures with your review. Please refrain from submitting plagiarized or false content and write your reviews based solely on your personal experiences and opinions.
Please refrain from using any foul, abusive, hateful or prejudiced language.
Please inform the appropriate authorities directly in case of any complaints with a business, especially those that involve illegal or inappropriate activities or health code violations.
Every review you post is the property of Foodoo does approve or reject the reviews that you post.

Photo guidelines

Food & Ambiance shots must be clear, in focus and only of that particular restaurant.
Duplicate, plagiarized, promotional, objectionable or derogatory photographs should not be posted.

Everything you share, including reviews, photos, your profile and comments are all subject to the guidelines above.
Users are prohibited from posting or transmitting any defamatory, obscene, pornographic, profane, threatening or unlawful material or any content that could constitute or encourage conduct that would be considered a criminal offense or harm minors, contain software virus, give rise to civil liability, or otherwise violate any law.
Foodoo assumes no responsibility arising from the contents of any communications containing any such material.
Foodoo reserves the right to change, edit or remove any user material or conversations that are illegal, indecent or violate company policy.
Foodoo will fully cooperate with any law enforcement authorities or court order requesting or directing Foodoo to disclose the identity of anyone posting such remarks.
